These Terms of Use are published under Article 10 of Spanish Law 34/2002 on information society services and electronic commerce (LSSI-CE) and govern access to and use of the site.
2. Acceptance
Accessing the site, or using any of its pages, means you accept these Terms in full, with the same effect as a signed agreement. If you do not accept them, please do not use the site. They apply together with our Privacy Policy, which forms part of them.
We may change these Terms. The version published here is the one in force and its date appears at the top; continued use of the site after a change means you accept the new version.
3. What this site is — and what it is not
The site presents the property and allows you to check availability, book and contact us. It is an information and booking channel, not a source of professional advice.
Bookings are governed by our General Terms & Conditions of a stay (Terms & Conditions), which you accept when you make a booking and which prevail over anything said about a stay on these pages. Where you book through a third-party platform, that platform’s own terms also apply to your use of its service.
Photographs, descriptions, plans and distances are indicative. The property, its furniture and its garden may change, and the photographs do not form part of the contract except where the booking confirmation says so expressly.
4. Use of the site
You may view, use and print the pages for your own personal, non-commercial purposes. You may not, in particular:
- use the site for an unlawful purpose, or in a way that infringes the rights of anyone else;
- copy, reproduce, publish, adapt or commercially exploit its content without our prior written permission;
- use automated means to extract content or to place bookings (scrapers, bots, crawlers), other than standard search-engine indexing;
- attempt to access restricted areas, probe or test the security of the site or of any connected system, or interfere with its operation;
- introduce viruses or any other harmful code;
- collect personal data of other users;
- impersonate anyone, or misrepresent your connection with us.
5. Intellectual property
The site, its design, structure, texts, photographs, videos and the “La Escribana” name and logo belong to Persimmon, S.L.U. or are used with the permission of their owners, and are protected by intellectual and industrial property law. Nothing in your use of the site transfers or licenses any of those rights. Any use beyond what is permitted in section 4 requires our prior written consent.
If you send us a review, comment, photograph or other content, you confirm that you have the right to do so and you grant us a non-exclusive, free licence to use it on our channels, identifying it as yours where reasonable. We will remove it on request.
6. Links
Some pages link to third-party sites — for example booking platforms, maps or social networks. Those sites are operated by their own owners, we do not control them and we accept no responsibility for their content, availability or data practices. Visiting them is at your own risk and under their terms.
You may link to our home page, provided the link is accurate, does not imply endorsement or a relationship that does not exist, and does not frame our content. We may ask you to remove a link at any time.
7. Availability
We try to keep the site available and accurate, but we do not guarantee uninterrupted, timely or error-free operation, nor that the content is complete or up to date at every moment. We may suspend, restrict or change the site, or any part of it, without notice, including for maintenance. Availability information on the site is indicative and only the booking confirmation binds us.
8. Liability
To the extent permitted by law, we are not liable for loss or damage arising from your use of, or inability to use, the site, from reliance on its content, or from any interruption, error, virus or third-party content.
Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud or wilful misconduct, and the rights that Spanish consumer legislation — in particular the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU) — grants to consumers and users. If you are a consumer, you keep all of them.
9. Personal data and cookies
We process personal data as described in our Privacy Policy, which explains what we collect, why, who receives it, how long we keep it and how to exercise your rights. The site sets no advertising or analytics cookies; see section 12 of that policy for the detail.
10. Complaints and dispute resolution
If something goes wrong, write to [email protected]. We will try to resolve it amicably and, where the matter concerns the accommodation service, we will tell you how to request the official complaint forms (hojas de reclamaciones) and the Andalusian consumer authority that can hear the case. This does not restrict your right to go to court.
11. Governing law and jurisdiction
These Terms are governed by Spanish law. Disputes are submitted to the courts and tribunals of Sevilla, Spain — except that, where you contract as a consumer, the mandatory rules on jurisdiction apply, and you may bring proceedings before the courts of your own domicile.
